Per plaintiff depositions, 18-year-old Fethi Ildır lived in the İdil district of Şırnak with his parents. One day in 1993, he was abducted by village guards who were known to be affiliated with the Hezbollah organization. On 19th September 1993, Fethi Ildır’s body, with feet and hands cut off from his body, was found about 3 km away from the highway between Cizre and İdil. After his son’s disappearance and subsequent death his father applied to the Cizre Public Prosecutor’s Office, which launched an investigation (file no.1993/492). In 2003, a standing search warrant was issued, with 2013 being designated as the statute of limitation.
In 2009, the family’s lawyer submitted a new criminal complaint to the Cizre Chief Public Prosecutor’s Office.

After his son’s disappearance and subsequent death Fethi Ildır’s father, Hüseyin Ildır, applied to the Office of Cizre and İdil Chief Public Prosecutors. The investigation file went in between two offices due to decisions of lack of jurisdiction. Mehmet Şerif Tanrıverdi, Cemal Gözüncü, Behrem Gözüncü and Süleyman Güngör were the main suspects of Fethi Ildır’s murder. Lastly, on March 19, 2009 the lawyer of the family submitted a petiton for trialing of suspects. Hafıza Merkezi does not hold further information regarding the progress of the judiciary process.
