Per Yakay-Der records and Özcan Sapan’s book “Beyaz Ölümün Güncesi” (The Diary of White Death), twenty-six-year-old Hayrettin Eren’s family house was being raided by the police on a frequent basis since May 1980. On 21st May 1980, he was arrested with a friend of his in İstanbul and taken to the Karagümrük Police Station. His family was told that he had been taken to the Political Crimes Branch in Gayrettepe and they found his car in the parking lot of the building; however, the police officers denied that Hayrettin was there. The criminal complaint filed by the family did not lead to an investigation despite five witnesses placing him at the Gayrettepe branch.
In 2011, the Eren family filed yet another complaint along with eleven others for family members killed or disappeared after the 1980 coup; in 2014, the investigation was dismissed due to statute of limitations. The case is under review at the Constitutional Court

The criminal complaint filed by the Eren family for their son Hayrettin, who had disappeared after being arrested in İstanbul on 21st November 1980, did not lead to an investigation in the 1980s.
On 3rd March 2011, Hayrettin Eren’s brother joined eleven others lodging a criminal complaint for their relatives who were killed or disappeared during the 1980 military coup.
In 2014, the Istanbul Chief Public Prosecutor’s Office closed the case (investigation file no.2012/40291) citing statute of limitations. After the families’ appeal was rejected by a higher court, they took the case to the Constitutional Court emphasizing that statute of limitations cannot apply to crimes against humanity. The application file was completed with the submission of missing documents on 14th July 2015.
