Per ruling delivered by the European Court of Human Rights on 6th November 2002, on 24th May 1994, shortly after the Çağlayan village of Diyarbakır’s Kulp district was evacuated and burnt down, the Mehmet Emin and Hasan Örhan brothers and the latter’s son Cezayir were taken by the Bolu 2nd Brigade in order to serve as guides from the hamlet where they continued to reside with the gendarmerie’s permission. Their family searched for them, to no avail.
In 2002, the ECHR ruled that articles 2 (right to life), 3 (prohibition of torture-with regards to the applicants), 5 (right to liberty and security), 8 (respect for private life and family) and 13 (right to effective remedy) were violated.
In 2007, DNA test performed on bones taken from a mass grave matched Mehmet Emin and Hasan Örhan’s DNA.
As of 2015, the family await permission to exhume the bodies for proper burial and the family attorney applied to the Diyarbakır Chief Public Prosecutor’s Office for a trial.

An investigation was initiated by the Kulp Chief Public Prosecutor’s Office on 8th June 1994, which ended in 1995 with a decision of “non-prosecution”

In 2006, Mehmet Emin’s son re-initiated the family efforts to locate the missing men.
