Per indictment bill prepared by the Diyarbakır Chief Public Prosecutor’s Office, Abdullah Efelti was living with his wife and seven children in the Bostancı village of Şırnak’s Silopi district. He was growing cotton. In 1994, he rented a piece of land to grow more cotton to pay for his debts, but was threatened by the Gendarmerie Commander and the Mayor Kâmil Atak not to do so.
Eventually however, having gotten permission from the military commander in Mardin, he planted the new lot anyway. The following day, several armed men came to his home and took him under custody saying that he would be released after giving his statement but he didn’t return home that night. His body was discovered by shepherds on 13th May 1995 near the Varlık village of Nusaybin district but the body was not given back to his family. Photos taken before burial showed that he had been shot in the head with a gun. Later, Cizre Municipality buried his body in a pauper’s grave.
No effective investigation was carried out until 2009 when the Diyarbakır Public Prosecutor’s Office prepared a bill of indictment concerning the enforced disappearance and arbitrary killing of 21 individuals by the then Cizre Gendermarie Commander, former Cizre Mayor, village guards, ex-PKK members-turned-JİTEM-employees and a gendermarie special sergeant. The case, which started in September 2009, ended with acquittal of all suspects on grounds of lack of sufficient evidence on 5th November 2015. Per documents submitted and issued during the investigation process resulting in the preparation of an indictment bill (file no.2009/972) by the Diyarbakır Chief Public Prosecutor’s Office, after the discovery of Abdullah Efelti’s dead body following his being taken into custody by a group of soldiers, the Cizre Chief Public Prosecutor’s Office launched an investigation (file no. 1995/239) Even though the family named the Cizre Gendarmerie Commander as the principal suspect, the Prosecutor’s Office routinely contacted the Cizre Gendarmerie Station for updates on the murder.
