- Event description
Per ruling delivered by the European Court of Human Rights on 19th October 2006, sixteen-year-old Zeki and his twelve-year-old cousin İlyas Diril disappeared after they were transferred to the Uludere Gendarmerie Station on 14th May 1994 following an ID check by the Uzungeçit gendarmerie; the date of the ID check is unclear with Zeki’s father claiming it took place on 2nd May 1994 and İlyas’ father 6th May, while the written records of the gendarmerie show 13th May. During the investigation process that was begun with the fathers’ application in August 1994, the Uludere Chief Public Prosecutor decided that the youths were placed under detention on 11th May 1994 with the allegation of aiding the PKK. Throughout the process, even though certain details of their version of the story changed, the military authorities insisted that İlyas was detained for a very short time by the gendarmerie due to his young age and Zeki, who remained under detention after İlyas’ release, was released not long after. In 2000, the Ministry of Justice made a decision of non-prosecution.
In 2006, the ECHR ruled that the articles 2 (right to life), 5 (right to liberty and security) and 13 (right to effective remedy) were violated.

- Summary of the legal proceedings
Per ruling delivered by the European Court of Human Rights on 19th October 2006, sixteen-year-old Zeki and his twelve-year-old cousin İlyas Diril disappeared after they were transferred to the Uludere Gendarmerie Station on 14th May 1994 following an ID check by the Uzungeçit gendarmerie.
An investigation was launched by the Beytüşşebbab Public Prosecutor’s Office after the families applied in search of their children.
During the investigation, the prosecutor’s office detected certain inconsistencies between the testimonies given by the military and requested permission from the Ministry to conduct a criminal investigation; which was granted. The military maintained that the boys were detained during an ID check with the suspicion of aiding the PKK; İlyas was released shortly later and Zeki was let go on the same night after giving a statement.
The Ministry of Justice made a decision of non-prosecution
the date of the ID check is unclear with Zeki’s father claiming it took place on 2nd May 1994 and İlyas’ father 6th May, while the written records of the gendarmerie show 13th May. In 2000, the Ministry of Justice made a decision of non-prosecution citing lack of evidence. The familied applied to the ECHR in 2001.
In 2006, the ECHR ruled that the articles 2 (right to life), 5 (right to liberty and security) and 13 (right to effective remedy) were violated.
