Per ECHR case file, Muhsin Taş was shot in the knees and placed under custody during a joint operation by the police and the gendarmerie on 14th October 1993 in Cizre, Şırnak. As his father sought information on his son, the Prosecutor’s Office issued firstly an extension on his detention and later informed him that Muhsin Taş fled and disappeared on 9th November 1993. The investigation initiated by authorities on the father’s insistence focused on Muhsin Taş’s affilition with the PKK rather than his escape from detention. In 1994, Muhsin Taş’s father applied to the ECHR, which found the report and testimonies provided by the authorities and witnesses inconsistent and implausible, ruling in 2000 that Turkey had violated 2, 3 (prohibition of torture)., 5 (right to liberty and security) and 13 (right to effective remedy).
Muhsin Taş has not been or heard from, nor have his bodily remains been found.

Per ECHR case file, about three weeks after Muhsin Taş was shot and placed under custody, his father, who had been applying to the Cizre Prosecutors Office to see his son was informed that his son had fled custody and disappeared, probably to join the PKK. On his father’s insistence, the Prosecutor’s Office launched an investigation into his affiliation with the PKK, rather than his escape from custody. The case exchanged hands between various Prosecutor’s Office and it was eventually dismissed on grounds that most of the written documentation was missing and it was impossible to identify officers who were responsible for his custody proceedings. Muhsin Taş’s father applied to the ECHR, which found the report and testimonies provided by the authorities and witnesses inconsistent and implausible, ruling in 2000 that Turkey had violated 2, 3 (prohibition of torture)., 5 (right to liberty and security) and 13 (right to effective remedy).
