Per case file, 20-year-old Mursal Zeyrek was living in the Aktepe village of Silopi, Şırnak at the time of his disappearance. Before he went missing, he had been detained by a 1st lieutenant from the Eren Batallion Command three times, during which, he was once photographed carrying arms by soldiers. On 26th May 1994, he was summoned to the Habur Frontier Company Command. When he went there with his brother, they were told that Mursal would be sent to Zaho in northern Iraq in order to gather intelligence on the PKK. However, within 15 minutes, Mursal disappeared.
Mursal Zeyrek’s family searched for him, to no avail.
He has not been seen or heard from; nor has his bodily remains been found.
Following his disappearance, his brother applied to military authorities, to no avail. In 2003, the brother applied to the Silopi Chief Public Prosecutor’s Office, which launched (2003/294) an investigation that was later dismissed (2004/82) in 2004 citing lack of evidence against alleged perpetuators. The brother’s appeal was also denied. In 2004, Mursal Zeyrek’s brother applied to the ECHR, which found the case (33100/04) inadmissible on account of article 34 and 35. In 2009, the brother applied yet again to the Silopi Chief Public Prosecutor’s Office demanding that alleged burial sites of victims of enforced disappearances be opened and tested for Mursal Zeyrek’s DNA. As of 2012, there has not been any development in the case (2008/3151).
