Per indictment bill prepared by the Muş Chief Public Prosecutor’s Office, after the Kızılağaç village in Muş was evacuated 54 villagers, including Mahmut Acar, Ali Can Öner, Yakup Tetik and Mehmet Emin Bingöl, returned to collect their belongings in November 1993. On their way back from the village, the villagers were taken to the Muş Province Gendarmerie Command. Per testimony of some of the detainees, PKK members identified aiders and abettors among the blindfolded villagers. While 50 villagers were released within 10 days, Mahmut Acar, Ali Can Öner, Yakup Tetik and Mehmet Emin Bingöl remained in detention. On 6th November, their dead bodies were discovered not far from the gendarmerie command.
In 2013, the commander of the Muş Province Gendarmerie Command was charged with the murder of the four men, along with other extrajudicial killings and activities. In 2014, he was acquitted due to lack of evidence. The case is under review by the Court of Cassation.

Per indictment bill prepared by the Muş Chief Public Prosecutor’s Office, the dead bodies of Mahmut Acar, Ali Can Öner, Yakup Tetik and Mehmet Emin Bingöl were discovered after all the other villagers detained for collecting their belongings from the evacuated village were released from the Muş Province Gendarmerie Command in November 1993.
Even though the bodies had signs of torture an autopsy was not performed and the families did not follow on the investigation process due to fear of retaliation.
