Per news article published in the Cumhuriyet Newspaper on 18th June 2017, Emin Kaya was married with four children and made a living carrying passengers in his minibus. He had never been to school. One day in 1994 he was taken into custody, when he returned home, he was no longer able to take care of himself, could not stand up or even drink water. He decided to leave his village to live in Istanbul.
Just before his departure, soldiers came to his village, Düğünyurdu in the Güçlükonak district of Şırnak and asked him to leave with them. He did not come back home that night .
The villagers who searched for him found his dead body inside the Tigris river. His organs had been taken out of his body and heavy stones had been placed in his abdominal cavity.
The family was forced to bury his body right away due to pressure from the Güçlükonak Gendarmerie Central Station. Only in 2009 his elder brother could ask for an autopsy to be performed on the body. The investigation of the prosecutor’s office is still ongoing as of December 2012.

Family of Emin Kaya, whose dead body was found after he left his village with soldiers in 1994, applied to the Office of Cizre Public Prosecutor in 2009 when they learned that enforced disappearances and extrajudicial killings that happened in 1990s in the region were being investigated. The Office of Cizre Public Prosecutor prepared a summary of proceedings for 20 people who were allegedly killed or disappeared between 1993 and 1998 in Güçlükonak district of Şırnak. In 2012, the proceeding, which inlcluded disappearance and killing of Emin Kaya, was sent to the Office of Diyarbakır Public Prosecutor for further investigation. The current situation of the investigation is unknown.
