Per ruling delivered by the ECHR on 31st May 2005 and case file (number 2014/223) being prosecuted at the 1st High Penal Court of Diyarbakır, the initial investigation to Abdulkadir Celikbilek’s abduction on 14th December 1994 and later killing produced no result for a long time. Realizing that nothing would come out of the investigation process in Turkey, the Çelikbilek family applied to the ECHR on 13th June 1995. The court decided that Turkey had been in violation of articles 2 (right to life), 13 (right to effective remedy) and 38 (right to individul application) of the European Convention of Human Rights and asked that Turkey pay compensation to the family. Years later, a former member of JİTEM (Gendarme Intelligence and Counter-Terrorism Unit, a clandestine paramilitary unit under Gendarme Forces) confessed that Abdulkadir was abducted by four JİTEM members including himself, interrogated with torture and eventually killed. A court case where 18 defendants, including a retired major, specialized sergeant and ex-PKK members-turned-JİTEM employees, are being held responsible for the killing of 13 individuals including Abdulkadir Çelikbilek was opened in 1999. The case went back and forth between the civilian and the military courts several times and as of 2015, it still continues without any arrest.
