Per ruling delivered by the European Court of Human Rights on 10th April 2006, after Mahmut and Fahriye Mordeniz’s son joined the PKK, the security forces began to harass and threaten the family. Later, two other sons of the couple also became PKK members and the harassment intensified; the security forces were pressuring the Mordeniz couple and their remaining son to work as informants. On 28th November 1996, the couple were placed under custody in Diyarbakır by armed men carrying police I.D.s and walkie-talkies; their dead bodies were discovered on 3rd December 1996 in Şırnak and they were buried in an unknown grave.
The legal process in Turkey dragged on without any substantial result. The couple’s son tried in vain to locate their grave and have it transferred to Diyarbakır.
In 2006, the ECHR ruled that Turkey had violated the articles 2 (right to life) and 13 (effective investigation) of the Convention.

On 28th November 1996, the couple were placed under custody in Diyarbakır by armed men carrying police I.D.s and walkie-talkies; their dead bodies were discovered on 3rd December 1996 in Şırnak and they were buried in an unknown grave.
During the investigation process, which was initiated by the İdil Chief Public Prosecutor’s Office, the file was transferred between various prosecutor’s offices, the last one being the Diyarbakır Chief Public Prosecutor’s Office. In the course of the investigation, the similarities between Mordenizs’ abduction as well as the murder weapon and other incidents in the region attracted the prosecutors attention and it was merged with other similar cases. The investigation is still on-going.
