Per friendly settlement reached at the European Human Rights Court on 18th December 2003, Şemsettin Yurtseven (73) Mikdal Özeken (18) and Münür Sarıtaş (13) disappeared after they were placed under custody on 27th October 1995 during a military raid on their village, Ağaçlı located in the Yüksekova district of Hakkari. On 13th June 1997, the Hakkari Chief Public Prosecutor’s Office charged the commander in charge of the military raid with beating Yurtseven to death and an ex-PKK member-turned-informant and a colonel with killing Özeken and Sarıtaş for witnessing the murder; they were acquitted in 1999 for lack of evidence and the decision was affirmed by the Court of Cassation in 2001.
In 2003, the families reached a friendly settlement with the Turkish authorities at ECHR in 2003.
