Per indictment bill prepared by the Diyarbakır Chief Public Prosecutor’s Office; Abdurrazak Binzet was a fourty-eight-year-old businessman, living in Silopi with his family. On 16th July 1997, he left home to go to the market and disappeared.
His dead body was found two days later, on the Silopi-Cizre highway, close to the Doruklu village. According to the autopsy report, he was run over by a car in an accident but his brother, who identified Abdurrazak at the crime scene, saw that there were no break marks on the road, and no blood at the scene. Moreover, it looked like he was tortured, run over by a car in another place and brought to the crime scene.
The family, having lost their faith in the judicial system, did not do anything about it until 2009 when the confessions of an anonymous witness in an investigation into the killings in Şırnak between 1993 and 1995 were published in the press. Per these claims Abdurrazak Binzet was tortured and killed in line with the direct order of a relative of theirs who was the head village guard and Mayor of Cizre at the time. The relative was at odds with Abdurrezak due to the latter’s approval for this relative’s collaboration with a gang formed by military staff, village guards and ex-PKK members carrying out extrajudicial killings. So in March 2009, Binzet’s brother applied to the prosecutor and asked that an investigation be made into the enforced disappearance of his brother.
Later in 2009, Diyarbakır Public Prosecutor’s Office prepared a bill of indictment concerning the enforced disappearance and arbitrary killing of 21 individuals –including Abdurrazak Binzet- by the then Cizre Gendermarie Commander, former Cizre Mayor, village guards, ex-PKK members and gendermarie staff. The case, which started in September 2009, ended with acquittal of all suspects on grounds of lack of sufficient evidence on 5th November 2015. It is under review by the Court of Cassation.
