İsmail Ağaya and his family had moved from their Gundénū (Yukarı Tekkeler) village in Sason county of Batman to Batman city;İsmail Ağaya worked as a shepherd and in various construction jobs, then started distributing the Özgür Ülke newspaper.
On 28th May 1994 he came home from work, then left saying he was going to his brother-in-law’s house. However, it soon became apparent that İsmail had not arrived at his brother-in-law’s house,upon which the family searched for İsmail at the police station and headquarters many times, while police officers visited the family’s house asking about his whereabouts. Shortly after his disappearance, women on the brother-in-law’s street told the mother that they had witnessed İsmail Ağaya being beaten and forced into a white Toros car by three plain-clothes men at gunpoint.
The mother also went to inquire about his son of Hizbullah members only to be told ”not to make a fuss about it, he would be released soon”. When the family hired a lawyer to help, the prosecutor’s office decided not to prosecute.
Later, İsmail Ağaya’s name was included among the 180 victims of unknown assailants in the summary of proceedings for investigation (no.2003/4131) and for decision (no.2011/169) prepared and submitted to the Diyarbakır Chief Public Prosecution Office by the Batman Chief Prosecution Office. He was not heard from again and his bodily remains were not found.

Based on the Batman Bar Association’s archives, İsmail Ağaya’s mother made a written request to the Batman Chief Public Prosecutor’s Office based on witness accounts of his son being forced into a White Toros car; thus began the mother’s many attempts to search for her son, which remained futile until the launch of an investigation by the Batman Chief Public Prosecutor’s Office into the murder of 180 victims, including İsmail Ağaya, possibly by the Hizbullah Organization. On 24 March 2014, the Batman Chief Public Prosecutor’s Office requested that the Diyarbakır Chief Public Prosecutor’s Office send court documents on the 180 victims (file no.2011/1228).
