Per testimony of his brother, on 10th April 1981 Nurettin Yedigöl went to his friends’ house in İstanbul after attending a wedding. Once at the house, he was arrested by police officers, who were already there. During their search efforts, his family got into contact with individuals, who had seen Nurettin Yedigöl under detention. Per their account, he had been severely tortured and the police officers made remarks about him indicating that he had died not long after.
In 2012, the family of Nurettin Yedigöl, filed a lawsuit against the chief of the division at the Istanbul Chief Public Prosecutor Office, which dismissed the case on grounds that it had previously been dismissed in 2007 due to statute of limitations. Even though the family appealed the case claiming that statute of limitations cannot apply to crimes against humanity, it was dismissed yet again.
In 2014, the lawsuit that was filed by Nurettin Yedigöl’s brother in 2011 along with other relatives of enforced disappearance victims was also dismissed. The families appealed the decision at the Constitutional Court, which declared lack of jurisdiction because the incident had happened before individual applications to the Court by private citizens was made possible in 2012.
