Per ruling delivered by the European Court of Human Rights on 22nd May 2001; Cemile Şarlı and her her brother lived in the Ulusoy (Vanik) village of Bitlis’ Tatvan district. On the night of 23rd December 1993, a shoot-out took place between PKK members and villagers tasked with protecting the village by the military. Later, in the early hours of 24th December, six men in camouflage uniforms went to the Şarlı residence looking for Cemile. When they finally found her, they left with Cemile and her brother Ramazan; the two siblings have not been seen or heard from, nor their bodily remains have been found.
The military authorities denied taking the siblings in custody, while the prosecutor’s office concluded that they had been abducted by the PKK.
In 2001, the ECHR ruled on the family’s 1994 application and decided that Turkey had violated articles 13 (right to effective investigation) and the now defunct article 25 (right to individual application).

Per ruling delivered by the European Court of Human Rights on 22nd May 2001; after the Cemile and Ramazan Şarlı siblings were taken away by six men in camouflage uniforms on 24th December 1993 from their house in the Ulusoy (Vanik) village of Bitlis’ Tatvan district, they disappeared.
Some of the eye witnesses claimed that the men in question were soldiers, while others contended that they were PKK members.
The Gendarmerie Command denied placing the siblings under custody. Concluding that they had been abducted by the PKK ,the Tatvan Prosecutor’s Office forwarded the file to the Diyarbakır State Security Court’s Prosecution Office, which issued a standing search warrant for the Şanlı siblings. The family applied to the Bitlis Prosecutor’s Office claiming that they had been taken into custody by the military, to no avail. In 1994, the family applied to the ECHR, which ruled in 2001 that Turkey had violated articles 13 (right to effective investigation) and the now defunct article 25 (right to individual application).
