Per the statement released by Cumartesi İnsanları on 22nd December 2012, 21-year-old Mahmut Kaya was detained while trying to hang a poster at the city square in Kars, on the second anniversary of the Maraş Massacre on 23rd December 1980, shortly after the coup of 12 September.
He was not heard from again, nor did the official authorities gave any information concerning his whereabouts to his family, although witnesses testified at court to have seen him under detention.
His bodily remains have not been found.

On 3rd March 2011, ten plaintiffs, including Mahmut Kaya’s family, filed a complaint at the İstanbul Chief Public prosecutor’s Office regarding extra-judicial killings, enforced disappearances and killings under custody during the military regime of the 12 September Coup, contending that statute of limitations cannot apply to crimes against humanity. In 2014, the case (file no. 2012/40291) was dismissed as well as the appeal filed by plaintiffs on 20th January 2015.
